Theft is punishable crime in the Pakistan Law. According to section 378 of P.P.C. Pakistan, “whoever intending to take dishonestly any movable property out of the possession of any person without that person’s consent, moves that property in order to such taking is said to commit theft.

Types of Theft

A conduct where someone unlawfully takes or controls someone else’s property with the intent to deprive the owner of its use or benefit. Theft may involve either movable or fixed property as well as services.

  • Theft by Deception – Creating or reinforcing a false impression, preventing another from acquiring information which would affect their judgment of a transaction, or failing to correct a false impression that was previously created or reinforced
  • Theft by Extortion – Taking the property of someone else by threatening to inflict injury, accusing someone of charges, exposing a secret to subject a person to contempt or ridicule, or by other means of inflicting harm
  • Theft of property that is lost, mislaid, or delivered by mistake – Coming into control of property with knowledge that it has been lost or given by mistake
  • Receiving Stolen Property – Knowingly receiving property that has been stolen or receiving property that the offender has reason to believe is stolen
Punishment of theft according to section 379 of P.P.C. Pakistan Penal Code is three year of imprisonment or fine or both.
There is difference in simple theft and theft is dwelling house. If a person commits theft in dwelling house which includes any building, tent, vessel used as human dwelling, he is punished with imprisonment which may extend to seven year or fine or both according to section 380 of P.P.C. Pakistan.
When a servant of clerk commit theft of property in his possession of his master than he is punished with imprisonment which may extend to seven years or fine or both under section 381 of P.P.C. Pakistan.
Theft of car is separate offense and there is separate punishment for theft of car under Pakistani law. According to section 381 A of P.P.C. whoever commit theft of car or any other motor vehicle, including motor-cycle, scooter and tractor shall be punished with imprisonment of either description for a term which may extend to seven years and with fine not exceeding the value of the stolen car of motor vehicle.
One thing should be clear that car snatching is an act of terrorism and totally different from car theft.
